Terms of Service

These Terms of Service govern access to and use of Sunday OS, a sales and customer-management platform. They are a contract between the business that signs up to use the service and the company that operates it. Our Privacy Policy explains how we handle personal information and is incorporated into these Terms by reference.

1. Who we are

Sunday OS is operated by "המרכז לעסקאות נדל״ן בע״מ" (The Center for Real Estate Transactions Ltd.), trading as "ווינרס נדל״ן בע״מ" (Winners Real Estate Ltd.), company number 516910775, of 3 Totzeret HaAretz Street, Petah Tikva, Israel ("Sunday OS", "we", "us"). "You" means the business that creates an account, and the individual accepting these Terms on that business's behalf.

2. Acceptance

By creating an account, signing an order form, or using Sunday OS, you accept these Terms on behalf of the business you represent, and you confirm you are authorized to bind that business to them.

If you don't agree to these Terms, don't create an account or use the service.

3. The service

Sunday OS is offered on subscription plans — Free, Starter, Pro and Enterprise — priced per business, not per user. Each business gets its own isolated account, with capacity and specific features varying by plan. Every plan includes the core CRM (leads, contacts, deals, pipelines) and, where applicable to the plan, the platform's built-in telephony, WhatsApp messaging and AI features.

We may add, change or discontinue individual features over time. Where a change removes something a plan relied on, we will try to give reasonable notice — see "Changes to these Terms" below for how that is handled formally.

4. Accounts and roles

Access to Sunday OS is through named user accounts issued by your business's administrators. Every user is assigned a role that determines what they can see and do: Admins see and manage everything, including other users and settings; Managers see and assign all of the business's records but cannot manage users or delete data; Reps see only the records assigned to them.

You are responsible for everything that happens under your accounts, and for keeping sign-in credentials confidential. Tell us immediately at privacy@sunday-os.com if you suspect unauthorized access to an account.

5. Acceptable use

You may not use Sunday OS to:

  • Send calls, WhatsApp messages or other communications to people who have not consented to be contacted, or in a way that breaches telemarketing, spam or consumer-protection law;
  • Upload, store or transmit content you do not have the right to process, or that is unlawful or infringing;
  • Attempt to bypass the separation between businesses' accounts, or access data belonging to another business;
  • Reverse-engineer, scrape, or attempt to extract the underlying software, or resell access to the platform without our written agreement;
  • Interfere with, overload, or attempt to gain unauthorized access to the systems the platform depends on, including its telephony infrastructure.

We may suspend an account we reasonably believe is being used this way while we investigate. That is not treated as early termination on our part.

6. Your data

For the leads, contacts, deals and other records you manage inside Sunday OS on behalf of your own customers and prospects, you are the controller of that data and we act as your processor — you decide what is collected and why; we process it to provide the service to you. Our Privacy Policy, section 2, sets this relationship out in full.

You own the data you put into the system. We claim no ownership interest in it, and we process it only as needed to run the service for you and as described in our Privacy Policy.

You are responsible for having the right to input any given person's data into the platform, and for using it in line with applicable privacy law. If your account is suspended or terminated, your data is not deleted automatically — see "Termination" below for what that means in practice.

7. Fees and billing

Fees are billed according to the plan you are on, in advance for the billing period stated at signup or on your order form. Prices exclude VAT unless stated otherwise.

If a payment fails, your account moves into a past-due state. We do not lock you out while a billing issue is being resolved — you and your team can keep signing in and using the service — but you should expect to see a payment prompt until the issue is corrected. Continued non-payment can lead to suspension, described under "Termination" below.

8. Availability

We aim to keep Sunday OS available and responsive, but we do not currently commit to a measured uptime service-level agreement. The service is provided on an "as-is", "as-available" basis.

Parts of the service depend on third-party infrastructure we do not operate — our telephony system routes calls over wholesale carrier networks, and call transcription and AI analysis rely on external AI providers. An outage or degradation on a provider's side can affect Sunday OS even when our own systems are healthy.

We may take the service down for planned maintenance. Where practical we do this outside normal business hours and give advance notice.

9. Third-party integrations

Sunday OS integrates with third-party platforms on your instruction — currently Meta (Facebook and Instagram lead ads) and WhatsApp, described in our Privacy Policy. When you connect one of these, you are also bound by that provider's own terms, and we are not responsible for its availability, its policies, or the accuracy of the data it sends us.

Connecting a third-party account grants us the permissions that provider's own consent screen describes, so we can retrieve and act on your business's data through it. You can disconnect a connected account at any time from Settings. Disconnecting stops new data from reaching us through that provider but does not delete records already received — the same distinction our Privacy Policy draws for Facebook lead data.

10. Intellectual property

Sunday OS — its software, design, and the Sunday OS name and mark — is our property or that of our licensors. These Terms grant you a right to use the service for your own business; they do not transfer any ownership in the platform itself.

Feedback you give us about the product — suggestions, bug reports and the like — we may use to improve Sunday OS without owing you anything for it.

11. No warranty

Except as expressly stated in these Terms, the service is provided without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that call recordings, transcripts or AI-generated summaries will be accurate or complete.

We hold no security certifications and do not claim compliance with any particular security standard or framework — the same statement our Privacy Policy makes under "Security".

12. Limitation of liability

To the maximum extent permitted by Israeli law, neither party is liable to the other for indirect, incidental, consequential or punitive damages, or for lost profits or lost data, arising from these Terms or use of the service.

Our total liability to you for any claim arising from these Terms is limited to the fees you paid us for the service in the three months before the event giving rise to the claim.

Nothing in this section limits liability that cannot be limited under mandatory Israeli law.

13. Termination

You can cancel your subscription at any time from Settings, or by writing to us; cancellation takes effect at the end of your current billing period unless we agree otherwise.

We can suspend or terminate an account for breach of the acceptable-use section above, for repeated non-payment, or where an account remains in an unresolved past-due state. This mirrors the account states the platform enforces automatically: an account that becomes trial-expired, suspended or cancelled is signed out and cannot sign back in until it is reactivated. A past-due account is not signed out on that basis alone.

A cancelled account's data is not deleted automatically — cancelled accounts are retained indefinitely so a business can be reactivated later without losing its records. If you want your data removed after cancellation, write to privacy@sunday-os.com; deletion is a request we act on manually, subject to the same retained-records exceptions our Privacy Policy describes under "What we retain even after a deletion request, and why".

14. Changes to these Terms

We may update these Terms from time to time. We will update the "last updated" date at the top of this page when we do, and where a change is material we will make reasonable efforts to notify account administrators before it takes effect. Continuing to use Sunday OS after a change takes effect means you accept it.

15. Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The courts with territorial jurisdiction over our registered office (Central District, Israel) have exclusive jurisdiction over any dispute arising from these Terms, and you consent to that jurisdiction.
